If I open a 6309 7040, (I'm going to attempt to regulate one plus I'd like to see the condition of the movement), should I always replace the case back gasket

They seem cheap on eBay - 10 for £10 - are these any good though, any recommends as to where to get them

I have some of that Seiko "silicon grease"

You're most likely going to end up repeatedly opening the case back to get it regulated. I'd say don't tighten the caseback fully till you're certain and satisfied with the results. This way you don't add wear on the gasket each time you tighten the caseback. Not sure if you've had the gasket replaced recently but either way I'd switch it out.
